Secondary school student sues Ekiti State Government

A secondary school student of Immaculate Secondary School, Ado-Ekiti has sued the State government and others for all edged breach of fundamental human right.

The Junior Secondary School 1 pupil, Gift Agenoisa is seeking for a total 15 million Naira damages.

It was gathered that she was suspended from school by the government after her parent allegedly beat up teachers who punished her for indecent dressing and gross indiscipline.

In a suit numbered HAD/01/CR/2021, sworn at Ado Ekiti High Court which was filed on her behalf by Mrs Odunayo Agenoisa claimed that the suspension infringed her rights.

The suit involves School Principal, Mrs F. M. Oluwasanmi (first respondent); Commissioner for Education, Dr Olabimpe Aderiye (second respondent); Ekiti State Teaching Service Commission (third respondent); and Ekiti State Government (fourth respondent).

The plaintiff in the affidavit claimed to have been singled out of assembly and was given 20 strokes of cane on May 22, 2021 as directed by the school Principal for an alleged indecent hairstyle.

The discipline she described as inhuman and cruel.

Gift in her summons through Mr Timmy Omotoso brought and brought pursuant to Order 2 rules 1,3,4,5 and 6 of the fundamental rights enforcement procedure rules 2009 as preserved by Section 315 of the 1999 constitution, the applicant demanded N15 million damages for her suspension.

Daily Post also gathered that she further demanded her immediate reinstatement into the school with unfettered access to all services rendered in the school.

She also claimed the beating gave her life-threatening scars adding that she fainted and was rushed to hospital.

Gift further stated that her letters of protest to the wife of the Ekiti State Governor and other agencies were ignored.

Meanwhile, the case which came up before Justice Lekan Ogunmoye of the Ekiti State High Court, on Thursday, was adjourned to September 22 for hearing.

On May 22, Elijah Agenoisa, the plaintiff’s father, who is a Police Sergeant, allegedly mobilised four armed policemen to the school to assault some teachers for scolding his daughter for coming to school with an indecent hairstyle, said to be against the school rules and regulation.

Consequently, the school suspended his daughter and the Ekiti State Police Command allegedly queried the policeman for his action, but it is not clear if he was punished by the police authorities.
